Terms and conditions

The General Terms and Conditions of Business set out the manner and conditions of operation of the NANU online shop (hereinafter referred to as the “online shop” or “Seller”), the rights and obligations of users and the operator of the online shop, and regulate the legal relations between the Seller and the Buyer. The General Terms and Conditions of Business also govern the individual rules for the purchase and delivery of goods.

The General Terms and Conditions of the NANU online shop are drawn up in accordance with the Consumer Protection Act(ZVPot), the Code of Obligations(OZ), the Personal Data Protection Act(ZVOP-1), the recommendations of the Chamber of Commerce and Industry and the international e-commerce codes.

The NANU online shop is managed by NANU Nuša Marinc s.p.

NANU Nuša Marinc s.p., is also the provider of e-commerce services and the controller of the personal data databases of the online shop (hereinafter also referred to as the provider and/or the seller.)

Users of the online shop are bound by the version of the General Terms and Conditions in force at the time of purchase (placing an online order). When placing an order, the user is reminded of the General Terms and Conditions and, by placing an order, confirms that he/she is aware of them. The General Terms and Conditions are also available for inspection at the Seller’s registered office.

Product offer and price

Due to the nature of doing business online, the offer is regularly updated and changed.

The price in the online shop is shown as the regular price without discounts and applies to all users of the online shop (hereinafter: online price). Prices are valid at the time of order placement.

The prices of the products in the online shop may differ from the prices of the same products in the Seller’s other sales outlets and are not correlated with each other.

Promotional prices of the Seller and of legal entities related to the Seller (hereinafter referred to as “related parties”), on other sales outlets and other promotions of the Seller and of related parties outside the Online Shop do not apply to online prices or to the Online Shop, except where specifically indicated in the context of a particular sales or promotional campaign of the Seller or of related parties of the Seller.

User registration (membership)

Users can have one of the following statuses within the online shop:

  • Guest (a visitor who does not register as part of an online shop visit or purchase of goods),
  • Member (a visitor who registers in the process of visiting an online shop or buying goods),
  • the buyer (the legal or natural person who purchases goods from the online shop).

Guests, Members and Customers are referred to collectively as “Users” throughout these Terms and Conditions.

No registration is required to buy from the online shop. Visitors to the online shop can make a purchase without registering by entering their email address and other required information in the online form.

Accessibility of information

The Seller undertakes to provide the following information to the User before the User is bound by the contract or offer:

  • details of the seller’s business (name and registered office, registration number),
  • contact details that allow the user to communicate quickly and efficiently (email, phone),
  • the essential characteristics of the products (including after-sales service and guarantees) and the period of validity of this information,
  • product availability,
  • the terms of delivery of the products (and the method, place and time of delivery),
  • prices,
  • the method of payment and delivery or performance, and the period of validity of this information,
  • the time validity of the offer,
  • the period within which the contract may be withdrawn from and the conditions for withdrawal (description of the right of withdrawal in accordance with Article 43c of the Consumer Protection Act; in cases where the consumer does not have a right of withdrawal in accordance with Article 43c of the Consumer Protection Act, the consumer shall be expressly informed of this),
  • an explanation of the complaints procedure, including full details of the contact person or customer service.

Order from

The contract of sale between the Seller and the Buyer is concluded in the online shop at the moment when the Seller receives a validly completed and confirmed purchase order from the Buyer within the online form. From that moment, all prices and other terms and conditions are fixed and apply to both the Seller and the Buyer. The Buyer shall be deemed to be the person with the details as stated at the time of placing the order. No subsequent changes to the Buyer’s details are possible. An archive of the data on the concluded purchase contracts is stored electronically on the Seller’s server.

Payment methods

The Seller offers the following payment methods:

  • cash/card on collection,
  • by payment on account (credit to the seller’s account),
  • by debit or credit card (MasterCard, Visa, Visa Electron, Maestro (with appropriate activation with your bank).

Invoicing

Upon delivery of the ordered products, the Seller shall also send an invoice to the Buyer in pdf format to the Buyer’s e-mail address or the Buyer shall receive a printed invoice for the purchased products upon delivery.

It is the Buyer’s responsibility to verify the accuracy of the information before placing an order. We will not consider any objections made afterward regarding the correctness of the invoices issued.

Prices are valid in the case of payment by the payment methods indicated above, under the conditions indicated above.

Discount code

During the purchase process, it is possible to redeem a discount code, if available. The user can enter an active discount code through the steps of purchasing goods in the online shop.

Discounts, promotional codes, etc. do not add up. Gift vouchers and discount bonus codes cannot be exchanged for cash.

Payment and credit cards

In the case of payment by debit or credit card, the following conditions also apply:

  • the payer (details in the user’s account) must be the same person as the owner of the debit or credit card,
  • the content of the order cannot be changed after confirmation of receipt of the order or. the final amount of the order, except exceptionally with the Seller’s approval,
  • the customer must comply with the general terms and conditions of the payment institution that issued the payment card.

In the case of purchases by companies, sole traders and other legal entities (hereafter: legal entities), please select the Invoice to legal entity option in the purchase process and enter the legal entity’s details.

Purchase procedure

The order in the NANU online shop is placed via a form. In addition to providing your first name, last name and place of delivery, you must also provide an e-mail address and telephone number, which are essential for communication and monitoring the status of your order and for subsequent delivery.

Procedure:

  1. Choice of items: in the online shop, you choose the item or several items you want and the quantity of the item. You still have the option to check the item details, change the item quantity and delete the item before clicking the button to complete the order.
  2. Order acceptance: after placing the order, the customer receives an email notification that the order has been accepted.
  3. Order Confirmed: if the buyer does not cancel the order (the order can be canceled until the order is processed), the order goes to further processing, when the provider reviews the order, checks the deliverability of the ordered items, and confirms the order or rejects it with a reason. The Provider may call the Customer on the Customer’s contact telephone number to verify the information or to ensure the accuracy of the delivery. The Supplier shall keep the Buyer up-to-date on the delivery of the Goods by e-mail. If the delivery time is very long and the Buyer does not wish to wait, the Buyer may notify the Supplier, who will remove the item from the order and refund any monies already paid to the Buyer and, at the Buyer’s option, either deliver the remaining items in the order or cancel the entire order. The tenderer shall not be liable for any damages resulting from longer delivery times or from non-delivery of goods that the tenderer does not have in stock in its own warehouse.
  4. Shipping of the goods: if the goods are in stock, the provider prepares and ships the goods, as a rule, within 2-3 working days from the confirmation of the order and informs the buyer about this by e-mail. In case of delay or complaints, the provider is obliged to explain to the customer the complaint procedure.

Complaint

The Buyer may claim the goods within eight (8) days of purchase if the goods do not have the characteristics expressly promised by the Seller, if the Seller has sent the wrong products, products in the wrong quantity or colour, or if the products otherwise deviate from the Buyer’s order.

In this case, the Buyer may request an immediate replacement with an identical, faultless product or, within the time limit and under the conditions laid down by law, a claim for material defect.

The goods received must be returned undamaged and in unaltered condition, in their original packaging with all labels and without signs of use!

The return of the received products to the company within the deadline for withdrawal from the contract is considered a notice of withdrawal from the contract. The consumer must return the product to the seller undamaged and in the same quantity, unless the product is destroyed, damaged, lost or its quantity has decreased through no fault of the consumer. The consumer may not use the products unhindered until the withdrawal from the contract.

The only cost to the consumer of withdrawing from the contract is the cost of returning the products (which, in the case of shipping, is charged according to the delivery service’s price list and depends on whether it is a consignment/package/cargo). The product must be returned to the Seller within 30 days of the date of the cancellation notice (purchase).

Delivery time and delivery

The delivery time is 3 days from acceptance of the order. The contractual partner for the delivery of items in the territory of the Republic of Slovenia is the company Pošta Slovenija, but the Seller reserves the right to choose another delivery service if this will enable the order to be fulfilled more efficiently.

Security

The Seller shall use appropriate technological and organizational means to protect the transmission and storage of personal data and payments.

Protection of personal data

The Seller undertakes to keep all personal data of the User secure at all times in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27. April 2016 (GDPR) and the Personal Data Protection Act.

The User should be aware that he/she is obliged to provide the Seller with his/her data in a correct and truthful form and to inform the Seller of any changes to his/her data. By accepting these Terms and Conditions, the User confirms that the personal data provided by him/her is correct.

Limitation of liability

The Seller shall use its best endeavors to ensure that the information published on its website is up-to-date and correct. However, the characteristics of the products, the delivery date or the price may change so quickly that the Seller is unable to correct the information on the websites. In such a case, the Seller will inform the Buyer of the changes and allow the Buyer to withdraw from the contract or exchange the product ordered. Images may be symbolic only and do not always fully reflect the actual situation.

Complaints and disputes

The trader shall make every effort to comply with its obligation to ensure an effective complaints handling system.

The Seller does not recognize any out-of-court consumer dispute resolution provider as competent to resolve a consumer dispute that a private user may bring under the Act on the Out-of-Court Settlement of Consumer Disputes.

Changes to the General Terms and Conditions

The Seller may amend and supplement these General Terms and Conditions. The legal relations between the Users and the Seller shall be governed by the version of the General Terms and Conditions in force at the time of placing the online order for the purchase of the Goods.
